Terms of Service

1. Acceptance of Terms

By accessing or using Groovjam ("the Service") at groovjam.com, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

These Terms apply to all visitors, users, and others who access or use the Service.

2. Description of Service

Groovjam is a web-based platform that enables users to create music through body gestures detected via a webcam. Features include gesture-controlled instrument zones, an AI music conductor, multiplayer JAM rooms, virtual instruments (keyboard, guitar, drums), and local audio/video recording.

3. Accounts

You must create an account to access the Service. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.

You agree to:

• Provide accurate and complete information when registering
• Keep your password secure and not share it with others
• Notify us immediately of any unauthorised use of your account
• Be at least 13 years of age, or have parental consent if under 18

We reserve the right to terminate accounts that violate these Terms.

4. Subscriptions and Billing

Plans

Groovjam offers a free plan and paid subscription plans (Pro, Band, Studio). Paid plan features and limits are described on the pricing page.

Billing

Paid subscriptions are billed in advance on a monthly or annual basis. Payments are processed securely by Stripe. By subscribing, you authorise Stripe to charge your payment method on a recurring basis until you cancel.

Cancellation

You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period. No partial refunds are issued for unused time, except where required by applicable law.

Price changes

We may change subscription prices with 30 days' notice. Continued use of the Service after a price change constitutes acceptance.

Refunds

We offer a 7-day refund on first-time purchases if you are not satisfied with the Service. Contact support@groovjam.com within 7 days of your first charge. Subsequent billing periods are non-refundable.

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any regulations
• Attempt to gain unauthorised access to any part of the Service or its infrastructure
• Reverse-engineer, decompile, or attempt to extract the source code of the Service
• Use automated tools (bots, scrapers) to access the Service without our permission
• Transmit harmful, offensive, or abusive content through JAM rooms or any other feature
• Resell or sublicense access to the Service without our written permission
• Interfere with or disrupt the integrity or performance of the Service

6. Camera and Microphone Access

The Service requires access to your webcam and optionally your microphone. You grant permission for this access through your browser. All camera and microphone processing occurs locally on your device. We do not capture, store, or transmit your camera feed or audio to our servers.

In JAM mode, your camera and audio may be transmitted directly to other participants via WebRTC peer-to-peer connections. You consent to this transmission when you join a JAM room.

7. Recordings

The recording feature saves audio/video files directly to your local device. You own all recordings you create. We have no access to these files. You are solely responsible for any recordings you share publicly or with others.

8. Intellectual Property

The Groovjam name, logo, platform design, and underlying software are our intellectual property and are protected by applicable copyright and trademark laws. You may not use our branding or reproduce our software without prior written consent.

Music you create using the Service is your own. We claim no ownership over sounds or compositions you produce.

9. Third-Party Services

The Service integrates with the following third-party providers:

• Stripe — payment processing
• OpenAI — AI Conductor feature (paid plans only)
• MediaPipe (Google) — body tracking (runs locally in your browser)

Use of these integrations is subject to their respective terms and privacy policies. We are not responsible for the practices of third-party services.

10. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components. Body tracking accuracy depends on your device, lighting conditions, and camera quality, which are outside our control.

11. Limitation of Liability

To the maximum extent permitted by law, Groovjam shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service, even if we have been advised of the possibility of such damages.

Our total liability to you for any claim arising from these Terms or the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless Groovjam from any claims, damages, or expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

13. Service Availability and Changes

We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice. We will endeavour to provide advance notice of significant changes that affect paid subscribers.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

15. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email or prominent notice on the platform at least 14 days before they take effect. Continued use of the Service after changes take effect constitutes acceptance.
